These Terms of Service ("Terms") govern your access to and use of our website at www.fromabovellc.net (the "Site"), hosted on Wix, as well as any services we provide, including but not limited to drone operations for inspections, mapping, photography, emergency support, and other offerings described on our Site (collectively, the "Services").

By accessing our Site or using our Services, you agree to be bound by these Terms. If you do not agree, please do not access the Site or use the Services. These Terms apply to all visitors, users, clients, and others who interact with us.

1. Description of Services

We provide a range of drone-based Services, including:

• Residential and commercial rooftop inspections

• Solar panel inspections (residential, commercial, and utility-scale)

• Agricultural data analysis and crop health monitoring

• Cell tower and infrastructure assessments

• High-resolution aerial mapping and 3D modeling

• Real estate and marketing photography/videography

• Emergency response support for police, fire, and search-and-rescue operations

• Pet and game recovery missions

• Gas and oil infrastructure analysis

Our Services are performed using FAA Part 107 certified pilots and enterprise-grade UAVs, such as the Autel Robotics EVO Lite 640T Enterprise ("Iris") and Autel Robotics EVO II Dual 640T RTK V3 Thermal Drone ("Shutter"). We utilize software like DroneDeploy and Pix4D for data processing and deliverables. All operations prioritize safety, compliance with FAA regulations, and client needs.

Services may involve collecting visual, thermal, or geospatial data from your property or specified areas. We require your consent and may need access to locations for drone flights.

2. Eligibility and Account

​

You must be at least 18 years old to use our Site or Services. By using them, you represent that you meet this requirement and have the authority to enter into these Terms.

If you create an account or submit inquiries via the Site, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

3. Booking and Payment

To book Services, contact us via the Site, email, or phone. We will provide a quote based on your needs. Acceptance of a quote and payment of any deposit constitutes a binding agreement.

Payments are processed securely through third-party providers (we do not store payment information). Full payment is due upon completion of Services unless otherwise agreed. We accept major credit cards and other methods as specified.

All fees are non-refundable except in cases of our inability to perform Services due to unforeseen circumstances (e.g., weather, regulatory issues), in which case we may offer rescheduling or partial refunds at our discretion.

4. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates laws, regulations, or third-party rights.

• Attempt to interfere with the Site's functionality, including hacking, transmitting viruses, or overloading.

• Use automated tools to scrape or extract data from the Site.

We reserve the right to terminate access to the Site or Services for violations of these Terms.

Any data captured during Services (e.g., aerial imagery) remains our property until delivered and paid for. We may use anonymized data for internal improvements or marketing, subject to our Privacy Policy.

7. Disclaimers and Limitations of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or Services, even if advised of the possibility. Our total liability shall not exceed the amount paid by you for the specific Service giving rise to the claim.

We are fully insured through SkyWatch, but this does not extend to your liability. You are responsible for ensuring your property is safe for drone operations and for any third-party claims arising from your use of our deliverables.

You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Site or Services, violation of these Terms, or infringement of third-party rights.

We shall not be liable for delays or failures in performance caused by events beyond our control, including weather, natural disasters, regulatory changes, equipment failure, or acts of God.
